Notice Pursuant to Personal Data Protection Act 2010

Nadayu Properties Berhad, which includes its subsidiaries, related, associated and affiliated companies whether present or future (hereinafter referred to as “our”, “us” or “we”) hereby would like to notify you, our valued customers or prospective customers, that this personal data protection notice (hereinafter referred to “this Notice”) is brought to your attention pursuant to the requirement of the Personal Data Protection Act 2010 and its regulations (hereinafter referred to as “the Act”).

We only collect, retain, use and disclose your Personal Data (defined herein below) in accordance with the Act.

This Notice describes how the Personal Data that you provide us will be used. For the purposes of this Notice, the term “processing” shall have the same meaning as prescribed in the Act.

In the event of any conflict between the English and Bahasa Malaysia version, the English version shall prevail. We shall have the right to modify or amend this Notice at any time and will place the updated Notice on our website at www.nadayu.com.my.

1. PROCESSING OF YOUR PERSONAL DATA
We may process your personal information and any additional information you voluntarily provide us from time to time, including but not limited to the following:-

(i)name, gender, date of birth, citizenship, marital status, spouse’s name, nationality, race, ethnic origin, identification card/passport details, qualifications, occupation, employer, former employer(s), photographs;
(ii)in the case of a company, the company name, registration number, business address, registered address;
(iii)contact preference details such as postal address, email address, telephone and fax numbers;
(iv)relevant bank/financier details, income tax file reference number and branch details, income/salary range, loan details, introducer’s name, address and identity card number;
(v)any such information as we deem necessary from time to time in connection with the commercial relationship between you and Nadayu;
(hereinafter collectively referred to as “your Personal Data”)


2. SOURCES OF PERSONAL DATA
To enable us to provide you the appropriate service, we may collect your Personal Data as provided by yourself and other sources, including but not limited to:-

(i)information provided by you and among other items, via registration forms, sales forms, and our website;
(ii)publicly available sources such as directories;
(iii)third party service providers, business partners, affiliates, and regulatory, government, statutory bodies and authorities;
(iv)other legal means or searches with relevant governing authorities, credit reporting agencies, and other related agencies which are legally permitted to collect, use, and process the personal data;
(v)our lawyers, consultants, auditors, accountants, bankers, and any other relevant parties/ service providers; and
(vi)other written and verbal communication between yourself and us or our authorised agents.


3. PURPOSES OF PROCESSING
In the course of providing service to you and implementing our business activities, it may be necessary for us and our service providers to process your Personal Data for the following purposes:-

(i)to communicate to you, on our invitations for present and future projects, and events as well as circulating relevant information such as newsletters, emails, brochures, leaflets, letters, flyers, and notices;
(ii)to assess your application(s) or request(s) for our products and services;
(iii)to facilitate the preparation of necessary documentation in relation to a commercial transaction including, but not limited to, preparation of the sale and purchase agreements and relevant documents;
(iv)to send out notices on progressive billings and other documents in connection with the commercial transaction;
(v)to verify your financial standing though credit reference, reporting checks, and other background checks on you as deemed necessary;
(vi)to process your payment transaction and collect your outstanding payment;
(vii)to conduct marketing and client-profiling activities;
(viii)to maintain and upkeep our customers’ records and data;
(ix)to conduct and perform market, demographics, or trend analysis/surveys;
(x)to respond to your queries;
(xi)to deliver vacant possession of our properties/products (e.g. keys-handover and defect rectification works);
(xii)to manage administrative matters, billing, complaints, and any other purposes relating to our properties;
(xiii)to transfer or assign our rights, interests and obligations under any of your agreements with us;
(xiv)to protect or enforce our rights to recover any debt owing to us;
(xv)for any other purpose that is required or permitted by any law, regulation, guidelines, and relevant regulatory authorities.
(hereinafter collectively referred to as “the Purposes”). You agree and consent to us collecting and processing your Personal Data in the manner identified in this Notice.


4. DISCLOSURE OF YOUR PERSONAL DATA
We may engage other companies, service providers, or professionals to perform functions on our behalf and consequently may disclose your Personal Data to the following class of parties and you hereby consent and authorise us to provide and disclose your Personal Data to the third parties such as those listed below (not exhaustive):-

(i)regulatory and government authorities, agencies and/or industry regulators in order to comply with statutory and government requirements;
(ii)information technology (IT) service providers;
(iii)government agencies, statutory authorities, and industry regulators;
(iv)external auditors, consultants, accountants, lawyers, bankers, estate agents or other financial or professional advisors;
(v)insurance providers;
(vii)contractors or third-party service or product providers;
(viii)third-party property management companies;
(hereinafter collectively referred to as “the Third Parties”)


5. PROTECTION OF YOUR PERSONAL DATA
We take the necessary precautions, both administrative and technical aspects, to safeguard your Personal Data against loss, theft, misuse and unauthorised access, disclosure, usage, alteration or destruction.

6. CONSEQUENCES OF FAILURE TO SUPPLY PERSONAL DATA
The supply of your Personal Data to us is voluntary. However, if you do not supply and consent to the processing of your Personal Data, we will not be able to communicate with you or provide you with the products and services that you require, including but not limited to the following:-

(i)to update you, our customer/prospective customer, on our products and services, upcoming events, as well as marketing and commercial materials which may be of interest to you;
(ii)to administer and give effect to the commercial transaction (i.e. obtaining relevant information to be used for preparation of the relevant sale and purchase agreement in relation to your purchase of our products and services); and
(iii)to send you notices for progressive billing relating to the commercial transaction.


7. RETENTION OF YOUR PERSONAL DATA

As our information storage facilities and services may be located in other jurisdictions, your Personal Data may be securely transferred to, stored, used, or processed within or outside of Malaysia.

We will retain your Personal Data for the fulfilment of the Purposes or as required for legal,regulatory and/or accounting purposes for as long as necessary.

You understand and consent to the transfer and retention of your Personal Data as described herein.

8. ACCESS TO, CORRECTION, AND LIMITING THE PROCESSING OF YOUR PERSONAL DATA

You may access and request for correction of your Personal Data where the personal data is inaccurate, incomplete, misleading or not up-to-date, to limit the processing of your Personal Data, or withdraw your consent to us processing your Personal Data at any time by writing to us in advance. Access to your Personal Data may be requested with a prescribed fee.

Notis Menurut Akta Perlindungan Data Peribadi 2010

Nadayu Properties Berhad, termasuk anak-anak syarikat serta syarikat-syarikat yang berkaitan, bersekutu, dan bergabung, sama ada masa kini atau masa hadapan (selepas ini dirujuk sebagai "kami", "kita" atau "kami") dengan ini ingin memaklumkan kepada anda, pelanggan yang kami hargai atau bakal pelanggan kami bahawa notis perlindungan data peribadi (selepas ini dirujuk sebagai “Notis ini”) diberikan kepada anda selaras dengan Akta Perlindungan Data Peribadi 2010 dan peraturan-peraturan (selepas ini dirujuk sebagai "Akta ini").

Kami hanya akan mengumpul, mengekalkan, menggunakan dan mendedahkan Data Peribadi anda selaras dengan Akta ini.

Notis ini menerangkan bagaimana Data Peribadi yang anda berikan akan digunakan. Bagi tujuan Notis ini, istilah "pemprosesan" akan mempunyai erti yang sama seperti yang ditetapkan dalam Akta ini.

Sekiranya berlaku sebarang percanggahan antara versi Bahasa Inggeris dan Bahasa Malaysia, versi Bahasa Inggeris akan diamalkan. Kami mempunyai hak untuk mengubahsuai atau meminda Notis ini pada bila-bila masa dan akan meletakkan Notis yang telah dikemaskini di laman web kami di www.nadayu.com.my.

1. PEMPROSESAN DATA PERIBADI ANDA
Kami mungkin memproses maklumat peribadi anda serta sebarang maklumat tambahan yang anda salurkan kepada kami secara sukarela dari masa ke semasa, termasuk tetapi tidak terhad kepada yang berikut:-

(i)nama, jantina, tarikh lahir, kewarganegaraan, status perkahwinan, nama pasangan, bangsa, kaum, asal-usul etnik, kad pengenalan/pasport, kelayakan, pekerjaan, majikan, bekas majikan, gambar;
(ii)jika ia adalah suatu syarikat, nama syarikat, nombor pendaftaran, alamat perniagaan, alamat berdaftar;
(iii)maklumat keutamaan perhubungan termasuk alamat pos, alamat e-mel, nombor telefon dan fax;
(iv)butiran bank/institusi kewangan yang relevan, nombor rujukan dan cawangan cukai pendapatan, skala gaji/pendapatan, butiran pinjaman yang dipohon, nama pengenal, alamat pengenal dan nombor kad pengenalan pengenal;
(v)sebarang maklumat yang kami perlukan dari masa ke semasa yang berkaitan dengan hubungan komersial antara anda dan Nadayu;
(selepas ini dirujuk sebagai “Data Peribadi anda”)


2. SUMBER DATA PERIBADI
Untuk membolehkan kami memberikan anda perkhidmatan yang bersesuaian, kami mungkin akan mengumpul Data Peribadi yang diperolehi anda serta maklumat daripada sumber-sumber yang termasuk tetapi tidak terhad kepada:-

(i)maklumat yang diberikan oleh anda dan antara lain, maklumat yang didapati daripada borang pendaftaran, borang jualan, serta laman web kami;
(ii)sumber umum seperti direktori;
(iii)pembekal perkhidmatan pihak ketiga, rakan kongsi perniagaan, serta badan-badan berkanun dan pihak berkuasa;
(iv)kewajipan undang-undang atau carian dengan pihak-pihak berkuasa yang berkenaan, agensi pelaporan kredit, dan agensi-agensi berkaitan yang dibenarkan untuk mengumpul, mengguna, dan memproses data peribadi;
(v)peguam, perunding, juruaudit, akauntan, ahli bank, dan sebarang pihak relevan/pembekal perkhidmatan; dan
(vi)komunikasi lain yang bertulis dan lisan di antara anda dan kami atau ejen yang dibenarkan oleh kami.


3. TUJUAN PEMPROSESAN
Dalam urusan memberikan anda perkhidmatan kami dan menjalani aktiviti-aktiviti perniagaan kami, kami serta pembekal-pembekal perkhidmatan kami mungkin perlu memproses Data Peribadi anda untuk tujuan-tujuan yang berikut:-

(i)untuk berkomunikasi dengan anda, seperti jemputan untuk pelancaran projek kami pada masa kini atau masa hadapan, acara dan pameran, serta penghantaran maklumat-maklumat seperti surat berita, e-mel, risalah-risalah, surat dan notis;
(ii)untuk menilai permohonan atau permintaan anda untuk produk dan perkhidmatan kami;
(iii)untuk memudahkan proses penyediaan dokumentasi yang diperlukan berhubungan dengan urus niaga komersial termasuk, tetapi tidak terhad kepada, penyediaan perjanjian jual beli dan dokumen yang kerkaitan;
(iv)untuk menghantar notis tuntutan berperingkat dan dokumen lain yang berkaitan dengan urus niaga komersial;
(v)untuk mengesahkan status kewangan anda melalui rujukan kredit, pemeriksaan laporan serta pemeriksaan latar belakang anda yang dianggap perlu;
(vi)untuk memproses transaksi pembayaran anda dan mengutip bayaran tertunggak anda;
(vii)untuk menjalankan aktiviti pemasaran dan aktiviti profil pelanggan;
(viii)untuk mengekalkan dan menjaga rekod dan data pelanggan;
(ix)untuk menjalankan dan melaksanakan analisis/tinjaun pasaran, demografik, atau trend;
(x)untuk menjawab pertanyaan anda;
(xi)untuk penyerahan harta/produk kami (seperti penyerahan kunci dan kerja-kerja pembaikian);
(xii)untuk berurusan dengan hal-hal pentadbiran, tuntuan bayaran, aduan, dan tujuan-tujuan lain berhubung harta-harta kami;
(xiii)untuk memindah atau menyerah hak-hak, kepentingan dan obligasi kami di bawah sebarang perjanjian anda dengan kami;
(xiv)untuk melindungi atau menguatkuasakan hak-hak kami untuk mengutip hutang anda kepada kami;
(xv)untuk tujuan-tujuan lain yang dikehendaki atau dibenarkan oleh mana-mana undang-undang, peraturan, garis panduan dan pihak berkuasa yang berkaitan.
(selepas ini dirujuk sebagai "Tujuan"). Anda bersetuju dan memberi kebenaran kepada kami untuk mengumpul dan memproses Data Peribadi anda dalam cara-cara yang tertulis di dalam Notis ini.


4. PENDEDAHAN DATA PERIBADI
Kami mungkin mengambil syarikat-syarikat lain, pembekal perkhidmatan, atau ahli-ahli profesional untuk melaksanakan fungsi-fungsi bagi pihak kami dan oleh itu mungkin mendedahkan Data Peribadi anda kepada kelas pihak-pihak ketiga tersebut dan anda bersetuju dan membenarkan kami untuk menyediakan dan mendedahkan Data Peribadi anda kepada pihak-pihak ketiga seperti yang disenaraikan di bawah (tidak menyeluruh): -

(i)pihak berkuasa dan kerajaan dan/atau agensi pengawal selia industri bagi mematuhi keperluan undang-undang dan kerajaan;
(ii)pembekal perkhidmatan teknologi maklumat (IT);
(iii)agensi-agensi kerajaan, badan-badan berkanun, dan pengawal selia industri;
(iv)juruaudit luar, perunding, akauntan, peguamcara, jurubank, ejen hartanah atau lain-lain penasihat kewangan atau profesional;
(v)pembekal insurans;
(vii)kontraktor atau pembekal perkhidmatan atau produk pihak ketiga;
(viii)syarikat-syarikat pengurusan harta pihak ketiga;
(selepas ini dirujuk sebagai “Pihak Ketiga”)


5. PERLINDUNGAN DATA PERIBADI
Kami mengambil langkah berjaga-jaga, dari segi pentadbiran dan teknikal, untuk melindungi Data Peribadi anda daripada kehilangan, kecurian, salah guna dan pengaksesan yang tidak dibenarkan, pendedahan, penggunaan, pengubahan atau pemusnahan.

6. AKIBAT KEGAGALAN MEMBEKALKAN DATA PERIBADI
Pembekalan Data Peribadi anda kepada kami adalah secara sukarela. Walau bagaimanapun, jika anda tidak membekalkan maklumat dan tidak membenarkan pemprosesan Data Peribadi anda, kami tidak akan dapat berkomunikasi dengan anda atau memberi anda maklumat mengenai produk dan perkhidmatan kami seperti yang anda perlukan, termasuk tetapi tidak terhad kepada yang berikut: -

(i)untuk mengemas kini maklumat terbaru mengenai produk dan perkhidmatan kami kepada para pelanggan/bakal pelanggan kami, acara yang akan datang, serta bahan-bahan pemasaran dan komersial yang mungkin menarik minat anda;
(ii)untuk mentadbir dan menguatkuasakan transaksi komersial (iaitu memperolehi maklumat untuk penyediaan perjanjian jual beli berhubung dengan pembelian produk dan perkhidmatan kami); dan
(iii)untuk menghantar notis tuntutan bayaran berperingkat berkaitan dengan transaksi komersial.


7. PENGEKALAN DATA PERIBADI ANDA

Oleh kerana kemudahan dan perkhidmatan penyimpanan maklumat kami mungkin terletak di wilayah yang lain, Data Peribadi anda mungkin dipindahkan, disimpan, digunakan, atau diproses di dalam atau di luar Malaysia.

Kami akan mengekalkan Data Peribadi anda selama yang diperlukan untuk memenuhi Tujuan-tujuan yang disebut atau seperti yang dikehendaki bagi tujuan undang-undang, pengawalseliaan, dan perakaunan.

Anda faham dan membenarkan pemindahan dan pengekalan Data Peribadi anda seperti yang dinyatakan di atas.

8. PENGAKSESAN, PEMBETULAN DAN PEMBATASAN PEMPROSESAN DATA PERIBADI ANDA

Anda boleh mengakses dan memohon membuat pembetulan kepada Data Peribadi anda di mana data peribadi adalah tidak tepat, tidak lengkap, mengelirukan atau tidak dikemaskinikan, serta membataskan atau menarik balik kebenaran untuk memproses Data Peribadi anda pada bila-bila masa secara bertulis terlebih dahulu. Akses kepada Data Peribadi anda boleh dipohon dengan bayaran yang ditetapkan.

Nadayu62 Condominiums
Officially Launched in Melawati

On 31 May 2014, Nadayu officially unveiled its first high-rise development in Melawati. The Nadayu62 condominiums follow in the footsteps of our multiple award-winning luxury bungalows launched in 2010 within the same master plan.

Held at the Nadayu Melawati Galleria, the launch saw about 1,000 people over the weekend.

The project had received significant interest even before the official launch – with 70% of 182 units pre-booked since its preview in January this year. Coupled with sales garnered from this official launch, the condominium saw an 85% take-up by the end of that weekend.

Nadayu62 is nestled in its own peaceful and green enclave while being just 15 minutes away from Kuala Lumpur city centre. Served by key highways including DUKE and MRR2, the property is also in close proximity to some major malls, hypermarkets, international and public schools, and a university college.

The project sits on a two-acre plot with a backdrop of the Kemensah Forest Reserve. Characterised by idyllic natural landscapes spanning the exclusive Taman Nadayu neighbourhood, the development epitomises a wholesome living environment for future residents.

Nadayu62 consists of two 15-storey blocks offering units ranging from 950 to 2,015 sq. ft. Each unit has a practical layout of three bedrooms and two bathrooms and furnished with good quality fittings to facilitate hassle-free occupation.

Every unit also comes with a fully-equipped kitchen with cabinets, cooking hob and hood, oven, and fridge. Additionally, a washer and dryer, built-in wardrobes and air conditioning units for all bedrooms, water heaters in all bathrooms, basic lighting and fan are all provided.

Other perks thrown in are two car park bays allocated per unit as well as a maintenance fee waiver for the first year. Facilities planned for Nadayu62 include a multi-purpose hall / gym room, swimming pool, garden with BBQ area, playground, kindergarten, and surau. The gated and guarded community is also secured by round the clock CCTV surveillance and RFID card access.

The project is expected to complete in 2017.

Homebuyers and Residents Celebrated
at Nadayu92 Kajang

Residents and homebuyers of Nadayu92 Kajang were feted with a night of delectable foods, engaging entertainment, and fun family games at an appreciation party hosted by Nadayu.

The event was organised to celebrate their support and also as a platform for both customers and Nadayu staff to bond. The party saw a 900-strong crowd gather at the sports complex located in the residential development.

The evening began as kids drew in from the playground nearby, attracted by the colourful animal balloons being crafted by a friendly clown. Apart from the main buffet spread, a long queue was seen quickly forming at the ice cream truck and a durian and mangosteen truck.

The evening was filled with joy and laughter as adults, parents, and children joined in games and won some mini prizes. To complete the party, the crowd was entertained with fire-eating performances and a magic show.

In his short address, Nadayu executive chairman Hamidon Abdullah expressed his gratitude for the trust and support given by the homeowners. He also touched on Nadayu’s desire to build communities that facilitate vibrant interactions and enable residents to enjoy living there.

The chairman of Nadayu92’s joint management body also delivered a brief speech recounting how the development has progressed to transform the landscape of the area.

Comprised of bungalows, semi-detached, and linked homes, Nadayu92 was idealized as a resort-style gated and guarded residence with beautiful landscapes and exclusive clubhouse facilities.

Today, Nadayu92 Phase 1 houses over 100 families and Phase 2 will be completed and handed over to residents this year. Eventually, all 421 homes of Phases 1 & 2 are anticipated to be home to a community of 1,700 people.
